Terms and Conditions

Thank you for choosing Creative Agent LLC for your real estate photography needs. By booking a photo shoot with Creative Agent LLC, you agree to the following terms and conditions:

1. Cancellation and Rescheduling

Creative Agent LLC understands that unforeseen circumstances can arise, and we strive to be as accommodating as possible. Clients may cancel or reschedule a photo shoot free of charge up to 2 hours before the scheduled appointment. Cancellations or rescheduling within 2 hours of the appointment will incur a $50 fee.

In case of bad weather, clients may reschedule free of charge up to 1 hour before the scheduled appointment. If the client wishes to cancel due to bad weather, the regular cancellation policy applies.

All late cancellations or rescheduling must be communicated by phone at (786) 600-5667 or email at support@creativeagentfl.com.

2. Licensing

Creative Agent LLC grants the client a worldwide, limited, fully-paid license to use the photographs for marketing the property specifically for MLS listings and professional self-promotion. This license does not permit the client to resell or gift the photographs. All intellectual property rights are explicitly held by Creative Agent LLC.

For uses beyond MLS listings, such as printing flyers or other marketing materials, additional licensing fees will apply. The client is responsible for obtaining any necessary permissions, clearances, or releases for uses beyond MLS listings.

Unauthorized use of the photographs beyond the granted license will constitute a breach of this agreement and may result in legal action.

3. Additional Fees

Any additional fees incurred beyond the photo shoot, such as parking or valet fees (up to $15), will be the client’s responsibility. Creative Agent LLC will provide receipts upon request, and the client agrees to pay these fees within 30 days of receiving the invoice.

4. Payment Terms and Late Fees

Clients agree to pay all invoices issued by Creative Agent LLC by the due date stated on the invoice. A late fee of 1.5% per month may be added to overdue amounts. If invoices remain unpaid after 60 days, Creative Agent LLC may engage attorneys or a debt collection agency, and the client will be responsible for any associated fees or costs.

5. Refund Policy

We have a no-refund policy on all orders. If the client is not satisfied with the quality of the photos, we will do our best to re-edit them.

6. Use of Subcontractors

We may use third-party independent contractors to provide portions of our services. The client acknowledges and agrees that some services may be provided by these contractors.

7. Delivery of Content

We aim to deliver content within 2 business days. Some projects may require additional time for optimization. We do not offer discounts for late deliveries due to extra editing.

8. Accuracy

We strive to photograph properties with the highest accuracy. However, we are not responsible for slight color variations or discrepancies in floor plan dimensions compared to tax rolls.

9. Home Preparation

The client, tenant, or agent is responsible for preparing the property before the photographer’s arrival, including decluttering, tidying, and cleaning interior and exterior areas.

10. Limitation of Liability

Creative Agent LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from the use or inability to use our services.

11. Liability

Clients agree that Creative Agent LLC, its employees, and independent contractors shall not be liable for any claims, expenses, damages, or losses arising from the services provided under this agreement. Clients acknowledge that the use of our services is at their own risk and that Creative Agent LLC, its employees, and independent contractors shall not be held responsible for any damages, injuries, or losses occurring on the property, during or after the photo shoot, or from the use of the photos or any other services provided. Clients agree to indemnify, defend, and hold harmless Creative Agent LLC, its employees, and independent contractors from any claims, expenses, damages, or losses arising from the services provided under this agreement.
